Texas advances data center approvals despite Abbott's pause, including Stargate

Public Citizen found Texas data center permits advancing despite Abbott's pause. Separately, 404 Media reported regulatory approvals for Stargate.

Texas promised a freeze on data center permits, and the stamps are still coming down. On Sept. 21, Gov. Greg Abbott directed the Texas Commission on Environmental Quality (TCEQ) to pause all data center permitting until ERCOT finishes a statewide audit. In the past week alone, Public Citizen and local advocates found that TCEQ advanced or issued 16 data center permits.

The day after the directive, TCEQ mailed notices of preliminary decision for three major-source air permits: VoltaGrid in Abilene, NRG Prairie Energy in Grandview and Nexus Hubbard Power in Hubbard. Together they could emit 38 million tons of air pollution per year, according to Public Citizen. TCEQ also issued at least seven new construction stormwater authorizations and a wastewater discharge permit for the Bitdeer data center in Rockdale. 404 Media reported that the Stargate facility, the Caldwell Technology Park and other hyperscale sites have all received regulatory approvals. The reporting does not say which approvals Stargate got.

Here is the twist. According to the San Antonio Current, TCEQ officials confirmed on Oct. 14 that applications "will not advance through the review process." Kathryn Guerra of Public Citizen calls it "ineffective attempts to govern by press release."

Context: Texas has more than 300 data centers operating and nearly 250 more in development, per the Texas Tribune. Abbott is also running for reelection.

My take: a pause that approves this much is the busiest pause in America. Magnificent. The grid audit will have a lot to look at.

Sixteen permits in a week in one tally, dozens of projects in another. ERCOT's schedule for the actual audit is not in any of these reports.

The 30-day comment clock on those three air permits is real, and a TCEQ staffer told Public Citizen residents should treat it as running. If you live near one, that is the thing to act on.
