Pennsylvania makes AI ad disclosures law as Shapiro signs SB 806

Pennsylvania's SB 806 requires disclosures for deceptive uses of AI in advertising, with exceptions. Gov. Josh Shapiro signed it Oct. 22, 2026.

Pennsylvania just put a label on the future of advertising, darlings. Gov. Josh Shapiro signed Senate Bill 806, the Artificial Intelligence Deceptive Advertising Act, on Thursday, Oct. 22, in a batch of 58 bills, according to City & State PA.

The rule: advertisers may not knowingly, recklessly or willfully run ads using synthetic content, meaning material significantly modified or generated by AI, in a way that creates a false consumer perception about what is being sold, without clear and conspicuous disclosure. The label must say the ad contains AI-modified or AI-generated content, appear in the same medium, show up the first time the content is presented, and be permanent or extraordinarily difficult to remove where technically feasible.

The teeth: the Attorney General or a district attorney can seek injunctions, and courts may award civil fines up to $3,000 plus attorney fees and court costs. The act takes effect in 60 days.

The context: the bill text exempts evidently fictional content, parody, satire, commentary, criticism and content limited to text. Audacy / KDKA Radio reports political ads are exempt, while Allegheny County Council separately approved an ordinance requiring county candidates to disclose AI in campaign ads starting in January.

Sponsor Sen. Nick Pisciottano, D-West Mifflin, called it a "major step for consumer protection in Pennsylvania." Shapiro, in a social media post, says more safeguards are needed on jobs, child safety and elections.

My take? A state just told advertisers to show their work, and the glamour of that is undeniable. Sixty days, and the labels arrive.

The bill text exempts content limited to text, yet The Verge and Audacy describe the law as covering text. One of those readings will meet a courtroom, and the statute is the one with the footnote.

Zola Kade

The label has to be permanent or extraordinarily difficult to remove "to the extent technically feasible." That is a lot of wiggle room, and the text gives ad networks no spec to build against.
