Arizona Court Tosses Manslaughter Sentence Over AI Video of Victim Shown to Judge

An Arizona appeals court vacated Gabriel Horcasitas' manslaughter sentence after a judge relied on an AI video of victim Christopher Pelkey. Resentencing is ordered.

The Arizona Court of Appeals has vacated Gabriel Paul Horcasitas' manslaughter sentence and ordered resentencing, finding that the sentencing judge's consideration of an AI-generated video of the victim "so prejudiced Horcasitas as to render the sentencing procedure fundamentally unfair." The conviction stands. The court rejected his argument about excluded text messages.

Horcasitas shot Christopher Pelkey, 37, on Nov. 13, 2021, during a road rage encounter at a stoplight in Chandler. He was convicted of manslaughter and endangerment. At the May 2025 hearing, Judge Todd Lang gave him the maximum. Outlets differ on the term: NBC News and ABC News say 10½ years, while BBC, CBS News and Global News say 10. ABC dates the appellate ruling to Sept. 30.

NBC News and CBS News reported that Pelkey's sister, Stacey Wales, made the video, and it played after nine relatives and friends spoke. "I believe in forgiveness," the AI Pelkey said. Lang responded: "I loved that AI." Horcasitas' trial attorney did not object.

Judge D. Steven Williams wrote for the panel that the video "erases the interpretive distance between the family's belief about what the victim would have said and the victim's own voice and opinions." Per the court, "No disclaimer could cure that error."
