> Meta's updated Commercial Terms make advertisers liable for its AI features' output, while admitting they can err. The effective date moved to Nov. 20.

Meta has rewritten the rules for its advertisers, and the new rule is gloriously simple: the machine may be wrong, but you pay.

According to The Keyword, a new clause in Meta's Commercial Terms, the contract behind business accounts on Facebook, Instagram, WhatsApp and Messenger, makes advertisers carry the risk of whatever its AI features create or change in their ads. The language, as quoted by CIO, says "AI features may make mistakes and may not always produce accurate, complete, or suitable results," and that customers "are solely responsible for and assume any and all risks associated with such AI features and any resulting content."

The date moved. CIO reported the changes would kick in October 30, but The Keyword says Meta shifted the effective date to November 20 on Friday, after complaints from publishers and advertisers.

Here is the sting. Meta's Ad Creative Generative AI Terms, in force since May 2024, began with "you may choose to use the Ad Creative AIs in your sole discretion." The Keyword says the new clause drops that condition. Digital agency Exverus has seen sitelinks added, copy translated and AI images built from a brand's own photos, sometimes on ads where nobody switched the feature on. And on October 28, Meta is turning on product browsing for existing ads unless advertisers opt out.

For context, the current terms, in force since March 6, 2024, do not mention artificial intelligence at all.

My take? Power does not get more elegant than this: the product is allowed to err, and the invoice for the error is yours.
